1 Agreement
1.1 These terms and conditions form the basis of the agreement between you and Juliet Grayson and William Ayot for the holiday rental of the Gatehouse together with all other conditions set out.
1.2 By signing the Booking Form you agree that you are over 18 years of age and that you accept full responsibility for all payments due and for the consequences of any actions of all persons who will use the Gatehouse during your holiday. If payment is made by credit/debit card by telephone, you will have deemed to have read all the Booking Conditions and agreed to be bound by them.
- Booking
2.1 Juliet Grayson or William Ayot will confirm the booking on receipt of the Booking Form and a deposit of one third of the holiday rental fee (“the Deposit”).
2.2 Once Juliet Grayson or William Ayot has confirmed the booking from you and has received the Deposit then an agreement exists between us on these terms and conditions.
2.3 Juliet Grayson or William Ayot will accept a provisional booking and reserve the Gatehouse for your holiday provided that we receive the Deposit from you within 3 working days.
2.4 If the holiday is due to start within 8 weeks of the date of booking the total of the holiday rental fee is payable at the time of booking.
2.5 No subsequent changes may be made to any part of the Booking Form without Juliet Grayson or William Ayot’s express written approval.
- Good Housekeeping Fund
3.1 We do not take a Good Housekeeping Deposit, but ask that you pay for any damage you cause to the property. We take it on good faith that you will recompense Juliet Grayson and William Ayot in full, and that your booking means that you have read these conditions and agree to this condition. Please do tell us about any damage (from a broken glass upwards, as we need to replace these before the next letting).
- Final Payment
4.1 The balance of the holiday rental fee less any Deposit will become due 8 weeks before the start of the holiday. Juliet Grayson or William Ayot will not send you a reminder or a receipt unless you have requested one and sent us a stamped addressed envelope at the time of booking. If the balance is not received on time Juliet Grayson or William Ayot will assume that you do not intend to continue with the holiday, treat it as a cancelled booking and retain the Deposit. If you wish to pay this online by credit card, please let us know and we will set up the invoice for you.
- Cancellation
5.1 You may cancel your booking at any time provided you do so in writing to Juliet Grayson or William Ayot but you will remain liable for the full balance of the holiday rental fee. Juliet Grayson or William Ayot will seek to re-let the Gatehouse for all or part of the booking period and, if successfully, will refund the money paid by you less an administrative charge of £100.
5.2 Juliet Grayson or William Ayot reserves the right to re-let at a discount or for a shorter period in which case we will pay the refund or a proportion of it if the Gatehouse is re-let for a shorter period, less the discount and administration charge.
5.3 See below (16) for the cancellation cover that you can buy through the Welsh Gatehouse.
5.4 Alterations are dealt with in the following way – as a cancellation and then a new booking.
5.5 Juliet Grayson or William Ayot reserve the right to cancel the booking any time in the event of circumstances beyond the reasonable control of Juliet Grayson or William Ayot or if in the reasonable opinion of Juliet Grayson or William Ayot it is necessary to undertake essential works at the Gatehouse. In these unlikely circumstances we will refund in full all money received by us for the booking. Juliet Grayson or William Ayot will not otherwise be liable for any loss incurred by you as a result of the cancellation.
5.5 COVID 19
If Monmoutshire goes into lockdown and you are not allowed to come to the Gatehouse we will notify you immediately and will offer a transfer to an alternative date or a full refund.
5.6 LOCKDOWN If the region you are travelling from goes into lockdown and you are not allowed to travel, we will not provide a refund. But will allow you to nominate an alternative guest who can stay during the dates you booked. There will be no additional charge for making this change.
- Change of Booking
6.1 Juliet Grayson or William Ayot will endeavour to assist you in a transfer of a booking to an alternative date at your request and an administrative charge of £100 will be made in such a case in addition to any increased rent due.
6.2 Changes cannot be accepted within eight weeks of the start date of the holiday. If a change results in a reduction in the length of the holiday it will be regarded as a cancellation.
- Occupation of the Gatehouse
7.1 You must not use the Gatehouse for any purpose other than that of a holiday. Functions, celebrations, ceremonies and parties are not permitted without the written permission of Juliet Grayson or William Ayot.
7.2 The maximum number of people permitted to stay in the Gatehouse is two people, and the use of tents or sleeping in motor vehicles adjacent to the Gatehouse is not permitted.
7.3 You must not use the Gatehouse for any activity or in such a way as to cause nuisance or annoyance to Juliet Grayson or William Ayot, their visitors or neighbours.
7.4 You and your guests must comply with any reasonable regulations relating to the Gatehouse, or the site within which the Gatehouse is situated, which will be communicated to you on your arrival at the Gatehouse.
- Your Obligations
8.1 You agree to keep the Gatehouse and its contents in the same condition and repair as on your arrival at the Gatehouse and to pay to Juliet Grayson or William Ayot upon written demand any costs incurred in making good any loss or damage to the Gatehouse or its contents caused by your action or omission or that of any guest accompanying you.
8.2 No pet is permitted at a Gatehouse. If you use a guide dog or a hearing dog and wish to stay at our Gatehouse, please discuss with our reservation staff, who will make every effort to accommodate your needs.
8.3 No smoking is permitted at the Gatehouse.
8.4 You undertake to keep the Gatehouse secure if left unoccupied during the period of let.
8.5 You must allow anyone authorised by Juliet Grayson and William Ayot to enter the Gatehouse during the holiday. Juliet Grayson and William Ayot will endeavour to give you reasonable notice of such a visit except in an emergency when immediate access must be allowed.
8.6 You must ensure that the Gatehouse is left in a clean and tidy condition on your departure at the end of your holiday. Juliet Grayson and William Ayot may make a charge for any additional cleaning if this is considered necessary.
- Juliet Grayson and William Ayot’s Right to Refuse/Terminate
9.1 Juliet Grayson and William Ayot reserve the right to refuse any booking.
9.2 Juliet Grayson and William Ayot reserve the right to terminate this Agreement and ask you and your guests to leave immediately if this is deemed necessary by Juliet Grayson and William Ayot as a result of your behaviour or that of your guests or any other material breach by you of the terms of this Agreement.
- Arrival and Departure
10.1 The holiday rental period begins at 2.00pm on the first day of the booking period and ends at 10.00am on the day of the departure. If your stay extends beyond this period you may be subject to a charge for the additional days. We ask that you honour these times.
- Description and facilities
11.1 Juliet Grayson and William Ayot will endeavour to inform you at the time of booking of any changes to the web site description of the Gatehouse or of any events which may be taking place at its site near the Gatehouse during your holiday. Juliet Grayson and William Ayot do not accept any liability for any works or activity of any sort occurring on its premises adjoining or neighbouring the Gatehouse.
- Tenancy
12.1 This Agreement is for the purposes of a holiday rental only and does not create the relationship of Landlord and Tenant between you and Juliet Grayson and William Ayot. You will not be entitled to a tenancy or to any other form of statutory security of tenure as a result of this Agreement.
- Complaint
13.1 If you have any cause for complaint during your holiday at the Gatehouse please notify Juliet Grayson, William Ayot, or Samantha Baker (P.A. to William and Juliet), who will make all reasonable efforts to assist and resolve the issue. Juliet Grayson and William Ayot will not normally make any refund or recompense in respect of a complaint made after departure if the complaint was not made known to them during the holiday rental period.
14 Lost Property
14.1 Juliet Grayson and William Ayot shall not be responsible for loss or damage to any of your belongings or for any injuries sustained by you or any of your guests however caused.
- Data Protection
15.1 All personal data provided to Juliet Grayson and William Ayot will be held and processed in accordance with the requirements of the 1998 Data Protection Act. We will keep your personal data safe and secure. We will not share it with other organisations without your knowledge and consent, unless required by law to do so.
16. No Strings Attached Cancellation Cover
16.1 For an extra 25% of the cost of your stay you can purchase a ‘no strings attached’ cancellation cover for the Welsh Gatehouse. Thus, if the unexpected happens and you have to cancel your holiday at the last minute for any reason, such as falling ill, suffering a sudden bereavement, having an accident that leaves you unable to travel, or being in an area that goes into local lockdown, you can cancel without penalty.
16.2 For bookings made after 15th November 2020, this cover must be purchased within a week of your original booking.
16.3 Once purchased, if you wish to cancel, you must notify us 72 hours or more before the first day of your stay. For example, if your stay starts on a Friday then you would need to notify us by 2pm on the preceeding Tuesday. .
16.4 The insurance only covers the ‘Welsh Gatehouse’ part of your stay, and does not cover any travel to or from the property, nor any other excursions or expenses you might incur by cancelling.
16.5 Once you have notified us, you will receive a full refund within 5 working days (usually sooner).
